For the foregoing reasons, plaintiffs motion for attorney's fees pursuant to 42 U.S.C. § 406(b) in the amount of $44,751.90 is GRANTED. Upon receipt of this sum, counsel for plaintiff shall refund the previously awarded $5,980.75 in attorney's fees, under the EAJA, directly to Mr. Sink. Plaintiff's motion for judgment on the pleadings is GRANTED and Defendant's cross-motion for judgment on the pleadings is DENIED. The case is remanded to the Social Security Administration for further proceed ings consistent with this Opinion to address the aforementioned gaps in the administrative record. The Clerk of the Court is respectfully requested to terminate the motions at ECF Nos. 18 and 21. The Clerk of the Court is also respectfully directed to close this case. SO ORDERED.
