OPINION AND ORDER: re: 24 MOTION to Dismiss filed by Costco Wholesale Corporation, Henkel AG & Company, KGaA. For the foregoing reasons, Defendants' motion to dismiss is GRANTED in part and DENIED in part. In accordance with this Opinion, Pla intiff's cause of action for injunctive relief is dismissed with prejudice, and Plaintiff's cause of action for negligent misrepresentation is dismissed without prejudice. Should Plaintiff seek to amend his complaint with regard to the negl igent misrepresentation claim, his request to amend must be made by letter application within fifteen days of the date of this Memorandum and Order. The letter shall address the legal bases upon which any proposed amendment would be based, and furthe r address why any amendment would not be futile or inconsistent with this Memorandum and Order. A proposed Second Amended Complaint must be appended to the letter request. Defendants are directed to respond to Plaintiff's letter application within ten days.
