For the foregoing reasons, Defendants' Motio n for summary judgment is GRANTED to the extent of dismissing with prejudice Plaintiffs federal claims and state law claims sounding in discrimination (i.e. the FHA claims, 42 U.S.C. §§ 1981, 1982, 1983 and 1985 claims and New York Exe cutive Law claims), and Plaintiffs state law claims are DISMISSED without prejudice to re-commence in state court. The Clerk of the Court is respectfully directed to terminate the motion at ECF No. 39, terminate the case, and enter judgment in accordance with this opinion. SO ORDERED.
