March 5, 2021 Opinion or Order Filing 110 ORDER: This case is now scheduled to proceed to trial beginning with jury selection on Wednesday, June 23, 2021. This is a firm trial date based on numerous scheduling considerations for the use of courtroom and jury selection space in the White P lains courthouse. January 29, 2021 Opinion or Order Filing 106 ORDER: As a result of movement in the comprehensive trial calendar for the White Plains courthouse, this case is no longer on backup status, and is now scheduled to proceed to trial beginning with jury selection on Wednesday, March 3, 2021. All pr etrial deadlines set at the January 11, 2021 status conference and in the Court's January 21, 2021 order (ECF No. 105) remain in place: (i) Plaintiff must submit proposed jury instructions by Friday, February 5, 2021; (ii) an in-person status conference is scheduled for Monday, February 22, 2021 at 11:00 a.m. at the White Plains courthouse; and (iii) the parties must provide each other and the Court with a tabbed binder or binders containing courtesy copies of that party's trial e xhibits and deposition designations (if any) no later than one week prior to the start of jury selection in this matter (i.e., by Wednesday, February 24, 2021). At the January 11, 2021 status conference, there was discussion about the logistical cha llenges of having Mr. Reno be present in the courtroom for the trial, and various alternatives for presenting Mr. Reno's testimony (including via videotaped trial deposition or via live video feed, if the Court's technological capabilitie s would permit). On or before February 9, 2021, the parties must meet and confer, and Plaintiff's counsel must advise the Court by letter filed on ECF how counsel would prefer to proceed with the testimony of Mr. Reno. This will allow the Cour t sufficient time to assess the technological options and notify the parties of any potential problems. In addition, the parties must submit a joint letter on or before Thursday, February 18, 2021 outlining any issues they would like to address at the final pretrial conference. January 21, 2021 Opinion or Order Filing 105 ORDER: The Court has reviewed the parties' pretrial submissions, including the proposed Joint Pretrial Order (ECF No. 104). While Section 6 of the Court's Individual Practices specifies the items required by the undersigned in advance of trial, the Court recognizes that the parties already had prepared and submitted versions of certain documents to Magistrate Judge Smith in late 2019 and early 2020, and the Court will not require the parties to submit revised jointly prepared vers ions of those documents. Specifically, the Court recognizes that: (i) both parties have submitted proposed voir dire questions (ECF Nos. 74 and 90); and (ii) defendants have submitted a proposed verdict form (ECF No. 76), and plaintiff has indicate d that he has no objection to this proposed verdict form (ECF No. 89). However, while defendants have submitted proposed jury instructions (ECF No. 75), the Court has not received any proposed jury instructions from plaintiff, despite multiple oppor tunities, see ECF No. 86, and Minute Entry dated Jan. 10, 2020. Plaintiff is hereby given one final chance to submit proposed jury instructions, which he must do by no later than Friday, February 5, 2021. In preparing his submission, plaintiff shou ld review defendants' proposed jury instructions (ECF No. 75), and indicate any proposed instructions to which he does not object. To the extent there are proposed instructions to which plaintiff does object, plaintiff should state those objec tions and propose alternate instructions (along with any additional proposed instructions) as appropriate. Finally, consistent with Section 6.C.3 of the Court's Individual Practices, the parties are directed to provide each other and the Court w ith a tabbed binder or binders containing courtesy copies of that party's trial exhibits and deposition designations (if any) no later than one week prior to the start of jury selection in this matter. January 14, 2020 Opinion or Order Filing 91 ORDER granting in part and denying in part 68 Motion in Limine. By Motion in Limine filed October 11, 2019, Defendants sought to limit the proposed testimony of Plaintiff's expert, Wayne A. Robbins, at trial. DE## 68, 69, 70, 71. Plaintiff opposed the Motion. DE ## 82, 82-1. For the reasons set forth herein, the motion is granted in part and denied in part. The opinions stated in paragraphs 5 and 6 are precluded; they apply solely to a Monell theory of liability, and are therefore i rrelevant. The undersigned has insufficient information to know what the opinion in paragraph 7 is, and what it is based on. No supporting documents have been provided to the Court. Before Plaintiff may offer any such opinion through Mr. Robbins, such documents, and a more fulsome description of the opinion, must be submitted to the Court. Such submission must take place at least one business day before the proposed testimony. This constitutes the Decision and Order of the Court. The Clerk is directed to terminate the gavel at DE# 68.
