Filing 197 OPINION & ORDER re: 125 MOTION to Certify Class filed by Michael Hellmann, Westchester Independent Living Center, Inc., Teresa Wheeler, Kayle Hill. Accordingly, Plaintiffs motion for class certification is GRANTED. The Court ce rtifies a Rule 23(b)(2) injunctive and declaratory relief class comprising students and visitors with mobility disabilities that is, individuals who use wheelchairs, individuals who use other mobility aids, and individuals with disabilities that aff ect their ability to walk distances or climb stairs but who do not use any mobility aids who have been and are being denied meaningful access to the educational, cultural, and social programs, services, and activities offered at SUNY Purchase becaus e of Defendants' continuing failure to provide accessible rights-of-way. The Clerk of Court is respectfully directed to terminate the pending motion. (Doc. 125.) Pursuant to my December 5, 2018 ruling, the parties are ordered to meet and confer on a schedule for cross-motions for summary judgment. (Minute Entry dated Dec. 5, 2018.)
