OPINION AND ORDER re: 51 MOTION for Summary Judgment and Judgment of Foreclosure and Sale filed by U.S. Bank Trust, N.A. For the foregoing reasons, Plaintiff's Complaint, (Doc. 1), is DISMISSED for lack of subject matter jurisdic tion, and Plaintiff's motion for summary judgment seeking a judgment of foreclosure and sale, (Doc. 51), is DENIED as moot. The Clerk of Court is respectfully directed to terminate the pending motion, (Doc. 51). Plaintiff may move to amend its C omplaint no later than August 21, 2018. If Plaintiff fails to so move, the Clerk of Court shall close the case without further order of the Court. The Clerk of Court is respectfully directed to mail a copy of this Opinion and Order to Defendant Gebman. SO ORDERED. (Amended Pleadings due by 8/21/2018.) ORDER: Plaintiff's statements of material fact are unaccompanied by citations to the evidence that support Plaintiff's assertion that the facts are undisputed. Accordingly, Plaintiff is ordered to resubmit its statements of fact, with cit ations to the record for each asserted undisputed fact, no later than 7 days from the date of this Order. No other alterations other than the addition of the citations are permitted. Defendant shall then file her response, if any, no later than 7 days from her receipt of Plaintiff's revised statements of fact. If Defendant does not respond within the allotted time, the Court will instead consider her prior response, filed January 18, 2018, (Doc. 55 at 1-7), to Plaintiff's 56.1 Statements in deciding the motion.
