July 14, 2020 Opinion or Order Filing 94 ORDER granting 84 FIRST MOTION to Dismiss Third Amended Complaint. Therefore, both because Plaintiff has conceded it and because the law dictates as such, any claims against Defendant Annucci are dismissed. The Action will continue as to the other Defendants. The Court will hold a telephonic status conference on July 22, 2020, at 10:00 a.m.to discuss a discovery schedule and case management plan.Counsel for Defendants are ordered to mail a copy of this Order to Plaintiff at the address listed on the Docket and certify to the Court that they did so by July 17, 2020. March 29, 2019 Opinion or Order Filing 63 OPINION AND ORDER: For the reasons stated above, Defendants' Motion To Dismiss is granted in part anddenied in part. Plaintiff's second, fourth, fifth, and sixth causes of action are dismissed withprejudice. Plaintiff's third and seven th causes of action are dismissed without prejudice. IfPlaintiff wishes to file a third amended complaint, Plaintiff must do so within 30 days of the dateof this Opinion. Plaintiff should include within that third amended complaint all changes tocorr ect the deficiencies identified in this Opinion that Plaintiff wishes the Court to consider. Plaintiff is advised that the third amended complaint will replace, not supplement, all prior complaints and filings. The third amended complaint must conta in all of the claims and factual allegations that Plaintiff wishes the Court to consider. If Plaintiff fails to abide by the 30-day deadline, his claims may be dismissed with prejudice. The Clerk is respectfully directed to terminate the pending Moti on, (see Dkt. No. 55), and to mail a copy of this Order to Plaintiff. The Court will hold a Status Conference on May 23, 2019, at 10:00 a.m. SO ORDERED.
