Filing 61 OPINION & ORDER re: 24 MOTION to Dismiss filed by Rosa Cabanillas, Westchester County Family Court, 53 MOTION to Dismiss pursuant to Rule 12(b)(1) and/or Rule 12(b)(6) of the Federal Rules of Civil Procedure filed b y Westchester County. For the foregoing reasons, Defendants' Motions are granted. The Court lacks jurisdiction to adjudicate any of Plaintiffs claims. This dismissal is without prejudice because Plaintiff has not yet amended his Complaint. This dismissal is also without prejudice as to Plaintiffs ability to file a complaint for false arrest, excessive force, and malicious prosecution against the officer or officers responsible for that alleged conduct.
