Filing 44 OPINION AND ORDER: For the foregoing reasons, Plaintiffs motion for summary judgment is GRANTED and Defendants' cross-motion for summary judgment is DENIED. The Fund must pay Plaintiff the full benefits to which he is entitled under the Plan ( retroactive and prospective), together with prejudgment interest at the rate of 9%. Judgment will be entered upon the parties' submission of costs and fees associated with this lawsuit. The Clerk of the Court is respectfully directed to terminate the motions at ECF Nos. 33 & 37.
