Sayegh, Board of Education of the City of Yonkers, 35 MOTION to Dismiss . filed by Mike Spano. For the foregoing reasons, De fendant Spano's motion to dismiss is GRANTED in part and DENIED in part. Defendant Spano's motion to dismiss Plaintiff's national origin discrimination claim is granted and the claim is dismissed without prejudice. Defendant Spano� 39;s motion to dismiss Plaintiff's tortious interference with a contract and slander per se claims are denied. Defendants Board's and Sayegh's motion to dismiss is DENIED. The Clerk of the Court is respectfully directed to terminate the motion at ECF Nos. 29 and 35. Plaintiff is granted leave to re- plead in conformity with this Opinion by October 15, 2018. Defendants are directed to file answers to Plaintiff's remaining claims on or before November 5, 2018. This constitutes the Court's Opinion and Order. SO ORDERED.
