May 26, 2020 Opinion or Order Filing 84 FINAL APPROVAL ORDER AND JUDGMENT: It is therefore ORDERED, ADJUDGED AND DECREED that: 1. The definitions and provisions of the Settlement Agreement (the "Settlement Agreement") are hereby incorporated as though fully set forth herein. Fo r purposes of this Order, capitalized terms shall have the meaning ascribed to them in the Settlement Agreement. 2. This Court has jurisdiction over the subject matter of the Settlement Agreement with respect to and over all parties to the Settlemen t Agreement, including all members of the Settlement Class. 3. The Court hereby approves the settlement and finds that the settlement is, in all respects, fair, reasonable and adequate to the Settlement Class Members, within the authority of the pa rties and the result of extensive arm's length negotiations, as further set forth. 9. The Court hereby awards to Class Counsel fees and costs of $100,000.00. 10. The Court hereby awards $7,500.00 to Plaintiff as an incentive fee in co mpensation for the time, effort and risk she undertook as a representative of the Settlement Class and in the settlement and release of any individual claims she may have as set forth in the Settlement Agreement. 11. American Express shall pay the aw ards to Class Counsel and the Class Representative, as well as amounts due to Settlement Class Members, as prescribed by the Settlement Agreement. November 21, 2019 Opinion or Order Filing 76 ORDER GRANTING PRELIMINARY APPROVAL OF CLASS SETTLEMENT AND CONDITIONALLY CERTIFYING SETTLEMENT CLASS granting 72 Motion to Certify Class; granting 72 Motion to Approve; granting 72 Motion to Appoint Counsel. Based upon the foregoing, IT IS HEREBY ORDERED: 1. Preliminary Approval of Proposed Settlement. The Settlement Agreement, including all exhibits thereto, is preliminarily approved as fair, reasonable and adequate and within the range of possible approval. The Court finds that: (a) the Settlement Agreement resulted from extensive arm's length negotiations; and (b) the Settlement Agreement is sufficient to warrant notice thereof to Settlement Class Members and a full hearing on the approval of the Settlement. 2. Class Cert ification for Settlement Purposes. The Court conditionally certifies, for settlement purposes only, the following Settlement Class under Federal Rule of Civil Procedure 23(a) and (b)(3), as further set forth. 3. Class Counsel. The Court appoints Bro mberg Law Office, P.C., and the Law Office of Harley J. Schnall, as counsel for the Settlement Class. The Court finds that these counsel are competent and capable of exercising their responsibilities as Class Counsel. 4. Settlement Hearing. A final approval hearing (the "Settlement Hearing") shall be held before the Honorable Vincent L. Briccetti, Courtroom 620, The Hon. Charles L. Brieant Jr. Federal Building and United States Courthouse, 300 Quarropas Street, White Plains, New York 10601, on 4/24/2020 at 11:00 am as set forth in the notice to the Settlement Class. 11. Stay of Proceedings. All proceedings in the action are stayed until further order of the Court, except as may be necessary to implement the terms of the settl ement. Pending final determination of whether the settlement should be approved, neither the Class Representative nor any Settlement Class Member, either directly or in any representative or other capacity, shall commence or prosecute against any of the Released Parties any action or proceeding in any court or tribunal asserting any of the Released Claims.
