November 19, 2021 Opinion or Order Filing 127 ORDER: By Order dated September 15, 2021, the parties were advised of the December 15, 2021, tentative date for jury selection and trial, and that this trial was a back-up to another trial scheduled for that date. (Doc. #113). It now appears high ly likely that the other trial will be going forward, However, the Court has been able to re-schedule the trial of this case for December 14, 2021 (which is a Tuesday). To be clear, jury selection and trial in this case is now scheduled for December 14, 2021. This is a firm date. In addition, this case is in the process of being transferred from Judge Briccetti to Judge Seibel. Judge Seibel will therefore preside at the trial of this case. Judge Seibel's Chambers will notify the-parties if the date for the final pretrial conference, or any of the pretrial deadlines, need to be re-scheduled. SO ORDERED. (Signed by Judge Vincent L. September 15, 2021 Opinion or Order Filing 113 ORDER: The parties are advised of the following change in the tentative date for jury selection and trial in this case: The tentative date for jury selection and trial is now December 15, 2021, at 9:30 a.m. This trial is currently a back-up to anot her trial scheduled for that same date pursuant to the Court's COVID-19 scheduling protocols. To be clear, the December 15 date is not a firm date. As soon as the Court determines whether this case can proceed to trial on December 15, 2021, or whether it has to be adjourned, the Court will notify the parties. March 18, 2020 Opinion or Order Filing 81 ORDER: It is HEREBY ORDERED: 1. All deadlines are stayed pending the outcome of defendants' interlocutory appeal currently pending in the Second Circuit. (Doc. #76). 2. Plaintiffs counsel advised the Court that he intends to move to dismiss the appeal. January 31, 2020 Opinion or Order Filing 75 OPINION AND ORDER re: 59 MOTION for Summary Judgment pursuant to FRCP Rule 56 filed by Douglas Solomon, Raymond Nargizian, Jill Weyers, Village of Monticello, Robert Mir, Carmen Rue. The motion for summary judgment is GRANTED I N PART and DENIED IN PART. Police Chief Robert Mir is entitled to qualified immunity. Plaintiff's First Amendment retaliation claim may proceed against all other defendants. By March 2, 2020, the parties shall file a Joint Pretrial Order in acco rdance with the Court's Individual Practices. All counsel shall appear for a status conference on March 18, 2020, at 2:30 p.m., at which time the Court will set a trial date and a schedule for pretrial submissions. The parties shall come prepa red to discuss whether the Court should refer this case to the Court's mediation program or to the magistrate judge for a settlement conference. The Clerk is instructed to terminate defendant Robert Mir from the docket and terminate the motion. (Doc. #59). SO ORDERED. (Status Conference set for 3/18/2020 at 02:30 PM before Judge Vincent L.
