ORDER: As a result of movement in the comprehensive trial calendar for the White Plains courthouse for the week of March 15, 2021, this case is no longer on backup status, and is now scheduled to proceed to trial beginning with jury selection on M onday, March 15, 2021. All pretrial deadlines set at the December 29, 2020 status conference remain in place: (i) all pretrial submissions are due Friday, January 29, 2021, and the parties are reminded to review the entirety of Section 6 of the und ersigned's Individual Practices for a list of all pretrial submission requirements; (ii) an in-person status conference is scheduled for Thursday, February 25, 2021 at 10:00 a.m. at the White Plains Courthouse, 300 Quarropas Street, White Pla ins, NY 10601; and (iii) the parties must submit a joint letter on or before Tuesday, February 23, 2021 outlining any issues they would like to address at the final pretrial conference., (Status Conference set for 2/25/2021 at 10:00 AM before Magistrate Judge Andrew E. ORDER: This case is set for trial on June 22, 2020. Due to the circumstance of the coronavirus -COVID-19 stay at home order the Court is unable to hold jury trials in the immediate future, and therefore the trial is adjourned without date. The ea rliest anticipated date for jury trials is expected to be in September or later. The Court does expect to be able to conduct bench trials in July and August, with the possibility of some witnesses appearing remotely by video. It is therefore order ed that counsel in this matter confer with one another as soon as reasonably possible to determine whether they would jointly consent to a bench trial. The parties should inform the Court by letter filed on ECF no later than June 12, 2020. If cou nsel do consent to a bench trial and would like to schedule a settlement conference, then contact the undersigned's chambers and the matter will be referred to a different Magistrate Judge for a settlement conference. If counsel do not conse nt to a bench trial and would like to schedule a settlement conference, then contact the undersigned's chambers to schedule such a conference. In the event that trial will go forward, either with or without a jury, then any in limine motions , and any required pre-trial submissions, are to be filed 21 days before the scheduled trial; opposition to any in limine motion will be due 14 days before the scheduled trial; replies will not be permitted.
