Filing 105 OPINION AND ORDER re: 79 FIRST MOTION for Summary Judgment . filed by NYS Dept. of Corrections and Community Supervision. The motion for summary judgment is DENIED IN PART and GRANTED IN PART. Plaintiff's discrimination claim sha ll proceed inasmuch as it concerns the discipline he received as a result of the June 16, 2016, altercation with Kanojia. Plaintiff's hostile work environment claim shall also proceed. The motion is granted in all other respects. The Court wil l conduct a case management conference on October 16, 2020, at 10:00 a.m., at which time the parties shall be prepared to discuss, among other things, the setting of a trial date and a schedule for pretrial submissions, and what efforts they have mad e or will make to settle this case. In light of the current public health crisis, the conference will be conducted by telephone conference. Plaintiff and defense counsel shall attend the conference by calling the following number and entering the acc ess code when requested:Dial-In Number: (888) 363-4749 or (215) 446-3662 Access Code: 170356. Filing 30 MEMORANDUM OPINION AND ORDER re: 14 MOTION to Dismiss the Amended Complaint (Partial) filed by NYS Dept. of Corrections and Community Supervision, Taconic Correctional Facility. Defendants' partial motion to dismiss is GRANT ED. Thus, the only surviving claim is plaintiff's Title VII claim against defendant DOCCS. By August 17, 2018, DOCCS shall file its answer to the amended complaint. The Court certifies pursuant to 28 U.S.C. § 1915(a)(3) that any appeal fro m this order would not be taken in good faith, and therefore in forma pauperis status is denied for the purpose of an appeal. See Coppedge v. United States, 369 U.S. 438, 44445 (1962). The Clerk is instructed to terminate the motion (Doc. #14) and terminate defendant Taconic Correctional Facility from the docket.
