For the foregoing reasons, Defendants' motion to dismiss is GRANTED in part and DENIED in part. Plaintiff's claim s arising from alleged violations of the New York Labor Law are dismissed. Plaintiff's federal claims arising from alleged violations of the Fair Labor Standards Act survive. Defendants shall serve an answer to the Amended Complaint by Oct ober 16, 2020. The parties are then directed to confer and submit the attached proposed case management plan and scheduling order by November 20, 2020.
