May 25, 2021 Opinion or Order Filing 117 ORDER: On March 26, 2021, the Court issued an opinion and order granting Defendant's motion to dismiss the third amended complaint without prejudice and granting pro se Plaintiff Isaiah Blanch leave to file a fourth amended complaint on or b efore April 30, 2021. (ECF No. 112.) The Court indicated that "[i]f Plaintiff does not file a Fourth Amended Complaint by April 30, 2021, and he cannot show good cause to excuse such a failure, the claims dismissed without prejudice by this O rder will be deemed dismissed with prejudice, and the case will be closed. (Id.) On April 5, 2021, the Court received a letter from Plaintiff requesting a 60-day extension of his time to file the Fourth Amended Complaint. (ECF No. 113.) The Court gave Plaintiff a one-week extension (to May 7, 2021) and directed Defendants to file a letter confirming Plaintiff's access to the law library (ECF No 114), which they did (ECF No 115). Plaintiff has not filed an amended complaint or otherwis e communicated with the Court since early April. Therefore, the claims previously dismissed without prejudice are dismissed with prejudice. The Clerk of Court is directed to mail a copy of this order to pro se Plaintiff at the address on ECF, show service on the docket, and terminate this case. SO ORDERED. October 9, 2020 Opinion or Order Filing 106 MEMORANDUM AND ORDER re: 105 Letter, filed by Isaiah Blanch, 104 Pro Se Memorandum to Change Address, filed by Isaiah Blanch. Therefore, because the Court does not find any circumstances which warrant the appointment of pro bono counsel at this time, Plaintiff's motion is DENIED without prejudice to renew at a later stage in the proceedings. The Clerk of Court is respectfully directed to mail a copy of this Order to Plaintiff at his address as listed on ECF and to show proof of service. SO ORDERED. December 2, 2019 Opinion or Order Filing 67 ORDER: Accordingly, it is hereby ORDERED that the September 30, 2019, Order to Show Cause (ECF No. 60) is deemed moot. In light of this, Plaintiff is directed to file a Third Amended Complaint on or before January 3, 2020. The Third Amended Compla int will completely replace, not supplement, the Second Amended Complaint. The Third Amended Complaint must include all of the factual allegations underlying Plaintiffs claims. Plaintiff is warned that, while leave to amend is to be freely given, "piecemeal pleading" is impermissible. See, e.g., Zito v. Leasecomm Corp., No. 02 CIV.8074 GEL, 2004 WL 2211650, at *26 (S.D.N.Y. Sept. 30, 2004). A Third Amended Civil Rights Complaint Form that Plaintiff should complete is attached to this order. If Plaintiff files an amended complaint, the Clerk of the Court will, if necessary, send instructions to Plaintiff to effect service on Defendants in accordance with Rule 4 of the Federal Rules of CivilProcedure.Should Plaintiff fail to timely amend the complaint, the Second Amended Complaint at ECF No. 30 shall be deemed the operative complaint. Defendants are granted leave to file their motion to dismiss, and to serve Plaintiff at the address listed on the docket on or before J anuary 31, 2020. The parties' briefing schedule is as follows: Plaintiffs opposition shall be served, not filed, on or before March 2, 2020. Defendants' reply shall be served on or before March 17, 2020. Defendants are directed to file al l motion documents, including Plaintiffs opposition, on March 17, 2020. The parties are reminded that they are to provide the Court with two courtesy copies of each submission on the date they serve that submission on their opponent. The Clerk of t he Court is respectfully directed to mail a copy of this Order to Plaintiff at his address on the docket and show proof of service on the docket. SO ORDERED.
