OPINION & ORDER re: 34 MOTION to Dismiss . filed by Frank Werlitz, 32 MOTION to Dismiss Notice of Motion. filed by Town of Fallsburg, Town of Fallsburg Code Enforcement Office. Accordingly, the claims against Werlitz are appropriately dismissed. For the foregoing reasons, Defendants' Motions to Dismiss are GRANTED with prejudice. The Clerk of the Court is respectfully directed to terminate the motions at ECF Nos. 32 and 34, enter judgment in favor of Defen dants, mail a copy of this Opinion to pro se Plaintiff, show proof of service on the docket and terminate the case.
