Filing 39 OPINION & ORDER re: 30 MOTION to Dismiss For Failure To State A Claim. filed by Tracy Mairs, David Warner, Patricia Simone, Eric Bitterman, Lloyd Newland, Terry Williams, Claudia Glaser, Tahira Dupree Chase, Greenburgh Central School District, Antionette Darden-Cintron., For the foregoing reasons, Defendants' Motion to Dismiss is GRANTED in part and DENIED in part. Defendants' Motion to Dismiss is GRANTED as to Plaintiff's claims against all Defendants for: age discrimination under the ADEA, race discrimination under Title VII, OWBPA and ADEA retaliation claims, and due process and stigma plus violations under §1983. Defendants' Motion to Dismiss Plaintiff's claims for Fourteenth Amendment Equal Protection against Principal Simone and Defendant Board members is also GRANTED. Defendants' Motion to Dismiss Plaintiff's claims for race discrimination under Title VII and the Fourteenth Amendment against Defendant Supe rintendent Chase is DENIED, and similarly, Defendants' Motion to Dismiss Plaintiff's breach of contract under New York State law is DENIED. Defendants are directed to file an ANSWER by August 30, 2019, and the parties are directed to subm it a proposed case management plan by September 13, 2019. The Clerk of the Court is respectfully directed to terminate the motion at ECF No. 30. SO ORDERED.
