March 12, 2024 Opinion or Order Filing 96 ORDER OF DISCONTINUANCE: On October 26, 2023, an order was issued on the parties' consent agreeing to disposition of this matter by the undersigned pursuant to 28 U.S.C. § 636(c). By letter dated March 11, 2024, the parties have reported to the Court that they have reached a settlement of this matter. Accordingly, it is hereby ORDERED that this action is dismissed with prejudice and without costs (including attorney's fees) to either party. If either party wishes to reinstate this matter, the party must make a letter application to the undersigned within 30 days seeking to reopen this matter. Any application to reopen filed after the 30-day period has expired may be denied solely for failure to meet the 30-day deadline. Any pending motions are moot. February 22, 2024 Opinion or Order Filing 94 TRIAL ORDER -JURY: Discovery having concluded in this matter, IT IS HEREBY ORDERED that the following procedures shall govern the trial in this matter: The parties shall file a proposed joint pretrial order in compliance with paragraph3.B. of this Co urt's Individual Practices on or before March 25, 2024. In order to provide the described materials by the above due date, the parties must cooperate in the preparation of these materials and their preparation must begin well in advance of the d ue date. The parties are directed to contact each other immediately on receipt of this Order to set up a schedule to exchange materials and otherwise comply with this Order. In the rare event that a lack of cooperation makes a joint submission imposs ible, each party is required to submit its own proposals separately on the due date. The Court will thereafter issue an appropriate sanction to the party or parties that it determines failed to cooperate. and as set forth herein. The attention of co unsel is directed to Local Civil Rule 47.1, which provides that the Court may assess the parties or counsel with the cost of one day's attendance of the jurors (approximately $1000.00) if a case is settled after the jury has been summoned o r during trial. A civil jury is considered summoned for a trial as of noon of the business day prior to the designated date of the trial. The Court has typically assessed such costs. August 8, 2023 Opinion or Order Filing 84 MEMORANDUM OPINION AND ORDER re: 72 MOTION for Summary Judgment filed by C&S Wholesale Grocers, Inc. For the foregoing reasons, Defendant's motion for summary judgment is granted as to Plaintiff's claims under NYLL sec tions 240(1) and 241(6), and denied in all other respects. This Memorandum Opinion and Order resolves docket entry number 72. The Court will refer the parties to the Mediation Program for settlement purposes by separate order. The parties must fil e a joint status letter by September 29, 2023; to the extent the parties have not reached settlement, the status letter must indicate whether both parties consent to trial of the case before Magistrate Judge Gorenstein (the parties' individua l positions on the matter of consent must not be disclosed if they are not in agreement). By separate Pretrial Scheduling Order, the Court will set the final pretrial conference in this case for December 8, 2023, at 11:30 am. The parties are direc ted to confer and make submissions in advance of the conference date in accordance with the scheduling order. SO ORDERED.
