March 27, 2019	Filing 37 OPINION & ORDER: For the foregoing reasons, Defendant's motion for summary judgment is DENIED as to Plaintiff's first cause of action and GRANTED as to Plaintiff's second cause of action. Plaintiff's cross-motion for summary j udgment is GRANTED as to its first cause of action and DENIED as to its second cause of action. Defendants are hereby ORDERED to grant Plaintiff's application for a building permit, attached as Exhibit B to Plaintiffs Complaint, and to issue t he permit. The Clerk of Court is respectfully directed to terminate the pending motions (Docs. 19, 29), enter judgment for Plaintiff on its first cause of action and for Defendant on Plaintiff's second cause of action, and close the case.
