August 26, 2019 Opinion or Order Filing 52 MEMO ENDORSEMENT on re: #49 Letter, filed by Vania May Bell. ENDORSEMENT: In the attached letter dated August 12, 2019, defendant Vania May Bell, proceeding pro se, requests that this "civil action [be stayed] pending resolution of [Bell's] indictment and attendant criminal proceedings." (Doc. #49). Plaintiffs have reported by letter that they consent to a stay of discovery, but only as to Bell, and that the case should otherwise proceed. (Doc. #50). Defendants Securities America, Inc., and Security Advisors, Inc., assert that no discovery should take place until their pending motion to compel arbitration is decided. (Doc. #51). Bell's request for a stay of the entire case is DENIED WITHOUT PREJUDICE. As noted, there is a pending motion to compel arbitration in this case. Until the motion is decided, the Court does not require anything further from the parties. Moreover, as the Court has previously ordered, discovery may proceed only after the pending motion is decided. (Doc. #48). Thus, at this time, Bell will not suffer any prejudice or interference with her constitutional rights in this case or her criminal case absent a stay; nor is a stay justified for any other reason. Cf. Louis Vuitton Malletier S.A. v. LY USA, Inc., 676 F.3d 83, 96-100 (2d Cir. 2012) (legal standard governing defendant's request to stay civil case in light of parallel criminal proceeding). Accordingly, exercising its discretion, the Court declines to stay the entire case. However, to be clear, all discovery is stayed pending resolution of the motion to compel. After the motion is decided, and depending on how it is decided, either the Court or the arbitrator will re-visit the question of whether and to what extent this case, or discovery in this case, should be stayed. Bell may refile her request to stay after the pending motion has been decided. The Clerk is directed to mail a copy of this Order to defendant Bell at the address on the docket. SO ORDERED.
