Filing 5 ORDER TO ANSWER, 28 U.S.C. 2241: The Court, having examined the petition in this action, which Petitioner filed pursuant to 28 U.S.C. 2241, hereby ORDERS that: 1. The Clerk of Court substitute, under Fed. R. Civ. P. 25(d), Kevin McAleenan, Acting Secretary of the Department of Homeland Security, for Kirstjen Nielsen. 2. The Clerk of Court shall electronically notify the Civil Division of the U.S. Attorney's Office for the Southern District of New York that this Order has been issued. 3. By October 14, 2019, the U.S. Attorney's Office shall file an answer or other pleadings in response to the petition. 4. By November 18, 2019, petitioner may file reply papers. 5. Petitioner states that the United States Court of Appeals for the Second Circuit granted his motion for stay of removal for 91 days, but the Circuit's records do not reflect that such an order was issued. Thus, to assure the Court's ability to resolve Petitioner's claim is not mooted by events, Respondents are further ordered to provide the Court with 48 hours' notice of any intent to remove Petitioner from the United States.
