Filing 13 ORDER NO. 28: The Court accepts a modified version of the plans proposed by each of the parties. The parties and the Court, at a date to be suggested by the parties, will conduct a random drawing of cases to replace the three removed due to Lexecon objections, and will select two new cases in Category 1 and one new case in Category 2 from this Second Bellwether Selection Pool. The PEC shall obtain Lexecon waivers in advance for all cases to be entered in the Second Bellwether Selection Pool for random selection. The parties may confer on whether the Second Bellwether Selection Pool should include cases filed after the April 30, 2019 deadline imposed for the initial round of random selection, and whether the two cases filed in the Southern District of New York should be added, and inform the Court of their decision. See Order No. 19, Dkt. 102, at P 9(b ). Following this second round of random selection, the parties will be permitted to each exercise two strikes in each Category, filing Notices of Bellwether Strikes 16 days after the date of the random selection from the Second Bellwether Selection Pool, by 5 p.m. The parties will then return to the timetable laid out in Order No. 19 and amended in Order No. 26, filing briefs on the remaining eight cases to the Court 10 days after filing the Notices of Bellwether Strikes. See Order No. 19, Dkt. 102, at P 12; Order No. 26, Dkt. 139. Order No. 19 has always directed the bellwether selection process toward an end where this Court, after random selection and briefing on at least eight cases by the parties, selects the final four bellwether cases for trial, two from each Category. Order No. 19, Dkt. 102, at P 12. The plan adopted by this Order best respects the expectations of both parties as embodied in Order No. 19 and will ensure that the remaining cases are of "average and representative merit." Id.
