ORDER terminating #25 Letter Motion for Conference. The Court reviewed the attached pre-motion letter from Defendants Westchester County, Westchester County Department of Correction, Commissioner Joseph K. Spano, and Correct Care Solutions, LLC (collectively, the "County Defendants and CCS") seeking to file a motion to dismiss the Complaint, dated August 24, 2020 (ECF No. 25; see also ECF Nos. 22 and 27). To date, Plaintiff has not filed a response. The Court waives the pre-motion conference requirement and grants the County Defendants and CCS leave to file their motion to dismiss with the following briefing schedule: moving papers are to be served (not filed) on November 20, 2020; Plaintiff's opposition is to be served (not filed) on December 21, 2020; County Defendants and CCS's reply shall be served on January 5, 2021. All motion documents shall be filed on the reply date, January 5, 2021. The parties shall provide two copies of their respective documents to chambers as the documents are served. As long as Judge Roman's Emergency Rules remain in place, copies shall be delivered to chambers in electronic form.
