While it is an exaggeration to say that Plaintiff suffers no prejudice from the stay, as the uncertain status of the MFN rule does leave Plaintiff in some limbo, Defendants should be given adequate time to consider how to proceed with the rule in light of the unanimous opinion of the courts to have considered the legality of the rule. However, Defendants should not assume that another request for a stay will be granted. This second stay will give Defendants a half-year to reach a conclusion about how to proceed with the rule.
