STIPULATION AND ORDER EXTENDING TIME TO RESPOND TO COMPLAINT: IT IS HEREBY STIPULATED AND AGREED by and between the undersigned attorneys for the parties, as follows: 1. The Plaintiff initiated a State Court Action, titled Richard E. Gordon v. Salo Aizenberg and Maytal Asset Management, LLC d/b/a Downtown Investment Advisory in New York State Supreme Court New York County with Index No. 160316/2020 on or about December 2, 2020. (State Court Proceeding). 2. The Summons and Complaint along with other documents set forth in the Affidavits of Service filed in the State Court Proceeding were served on Defendants on or about December 16, 2020. 3. Pursuant to Notice of Removal filed in this Court on January 4, 2021, the State Court Proceeding was removed.(Docket# 1). (Removed Complaint). 4. FRCP 81(c)(2)(C) provides Defendants with seven (7) days after the Notice of Removal is filed to answer or present other defenses or objections. 5. The time within which Defendants Salo Aizenberg and Maytal Asset Management, LLC d/b/a Downtown Investment Advisory may answer or otherwise respond to the Removed Complaint is hereby extended up to and including February 11, 2021. 6. No provision of this Stipulation and Order shall be constructed as a waiver of, and Defendants expressly reserves, any and all defenses. (Signed by Judge Valerie E.
