ORDER granting #10 Letter Motion for Conference re: #10 LETTER MOTION for Conference or in the alternative, an order remanding the case to state court addressed to Judge Philip M. Halpern from Matthew H. Woodard dated 03/15/2021. Based on Defendant's representation that it consents to Plaintiff filing an Amended Complaint, the Court grants Plaintiff permission to file an Amended Complaint pursuant to Federal Rule of Civil Procedure 15(a)(2). The Court deems the Amended Complaint (Doc. 10) the operative pleading in this action nunc pro tunc. Furthermore, the Court grants the parties' consent request to remand this action to the state court from which it came for lack of subject matter jurisdiction pursuant to 28 U.S.C. 1447(c). The Clerk is directed to send a copy of this Order to the Supreme Court of the State of New York, County of Westchester, and to close this action. All pending matters are hereby terminated.
