Our review of the notice of removal indicates that the notice is deficient in two respects. First, the notice of removal does not comply with Local Civil Rule 81.1, which, in cases involving a limited liability company (LLC), requires that a notice of removal include information regarding the residence and domicile and any state or other jurisdiction of which [a] party is a citizen for purposes of 28 U.S.C. 1332 for all of the LLC's partners or members, as well as the state or other jurisdiction of its formation. Second, the notice seems to be untimely. 28 U.S.C. 1446(b) provides that a notice of removal shall be filed within 30 days after the receipt by the defendant, through service or otherwise, of a copy of the initial pleading setting forth the claim for relief upon which such action or proceeding is based. Here, service of the complaint was completed on March 16, 2021 and there is no evidence that the grounds relied on in the notice of removal were unavailable at that time. Defendants failure to adequately respond to this letter by no later than November 24, 2021 will result in a remand of the action to state court. (Responses due by 11/24/2021.)
