Filing 18 ORDER granting #16 Letter Motion for Conference re: #16 FIRST LETTER MOTION for Conference for permission to file a pre-answer motion to dismiss the Complaint addressed to Judge Nelson Stephen Roman from Giacomo G. The Court has reviewed the attached letter motion from Defendants County of Westchester (the "County"), Thomas Gleason ("Gleason"), James Luciano ("Luciano") and Christopher Calabrese ("Calabrese") (collectively, the "County Defendants") requesting a conference in anticipation of filing a pre-answer motion to dismiss (ECF No. 16), as well as Plaintiff's attached reply letter (EF No. 17). The County Defendants are granted leave to file their pre-answer motion to dismiss pursuant to the following briefing schedule: - Defendants' moving papers are to be served (not filed) on April 3, 2023 - Plaintiff's opposition papers are to be served (not filed) on May 3, 2023; and - Defendants' reply papers are to be served on May 18, 2023. All motion papers are to be filed by the parties on the reply date, May 18, 2023. The parties are directed to provide Chambers with two physical courtesy copies of their motion papers on the same date they are served on opposing counsel. The parties are further directed to provide the Court with an electronic courtesy copy of the motion papers as they are served per this Court's local emergency civil rules.
