MEMO ENDORSEMENT on re: #9 Letter, filed by HBA&MFL NY LLC. ENDORSEMENT: The Court is in receipt of the attached letter from Plaintiff, dated April 1, 2024, seeking leave to a motion (1) to hold Defendants in contempt for violation of the temporary restraining order, (2) to strike Defendants' Answer, and (3) an award of Plaintiff's attorney's fees and costs. The Court is also in receipt of the letter from Defendants, dated April 4, 2024, opposing leave. Finally, the Court is in receipt of Plaintiff's response to Defendants' letter, dated April 4, 2024, opposing certain representations made in Defendants' letter. The Court waives the pre-motion conference requirement and grants Plaintiff leave to file its proposed motion in accordance with the following briefing schedule: (1) Plaintiff's moving papers are to be served (not filed) on May 6, 2024; (2) Defendants' opposition papers are to be served (not filed) on May 27, 2024; and (3) Plaintiff's reply papers are to be served on June 10, 2024. All motion papers are to be filed by the parties on the reply date, June 10, 2024. The parties are directed to provide Chambers with two physical courtesy copies of their motion papers on the same date they are served on opposing counsel. The parties are further directed to provide the Court with an electronic courtesy copy of the motion papers as they are served per this Court's local emergency civil rules. SO ORDERED. ORDER: Defendants have filed a Verified Answer, dated March 6, 2024 (ECF No. 6), to Plaintiff's Complaint, dated January 24, 2024 (ECF No. 1, Ex. 2). Thus, the Court waives the Initial Pre-Trial Conference requirement and directs the parties to submit a proposed Case Management Plan and Scheduling Order (blank form attached hereto) by March 28, 2024. After review and approval of the Scheduling Order, the Court will issue an Order of Reference to Magistrate Judge Judith C. McCarthy for general pretrial purposes. The parties are directed to contact Judge McCarthy within seven (7) business days of the date of the Order of Reference to schedule a conference. SO ORDERED.
