The plaintiff's motion for judgment on the pleadings 10 is granted, and the Commis sioner's cross motion for judgment on the pleadings 13 is denied. The Commissioner's decision is reversed, and the matter is remanded for further proceedings, including the issuance of a subpoena for N.L.K.'s complete treatment records from the Monsignor Carr Institute.
