January 30, 2020 Opinion or Order Summons Issued as to Whole Foods Market Inc. The Clerks Office has forwarded service packets to the US Marshal. (SG)
January 13, 2020 Opinion or Order Filing 3 ORDER granting #2 Motion for Leave to Proceed in forma pauperis. The Clerk of Court shall send to may a marshal form. If may wishes to use the marshals to effect service, he must complete the Marshal form and return the form to this court within 30 days of the date of this order. If may does not wish to use the Marshals to effect service, he must notify the Court in writing within 30 days of the date of this order and request that a summons be issued directly to him. If within 30 days of the date of this order, May has not returned the Marshal form or requested a summons, the Court may dismiss this action for failure to prosecute. Upon receipt of each completed Marshal form, the clerk of Court shall issue a summons and cause the Marshals to serve copies of the summons, complaint, and this order upon the named defendant without payment therefor, unpaid fees to be recoverable if this action terminates by monetary award in plaintiff's favor. regardless of which method of service May chooses, he must effect service within 90 days of the date the summons is issued. It is May's responsibility to inquire of the marshals as to whether service has been made and if necessary, to request an extension of time for service. If, within 90 days of issuance of the summons, May has not made service or requested an extension of time in which to do so, the Court may dismiss this action for failure to prosecute. May shall notify the Court in writing if his address changes. The Court may dismiss the action if May fails to do so.. Signed by Hon. Lawrence J. Vilardo on 1/13/2020.
