Filing 3 ORDER granting #2 Motion for Leave to Proceed in forma pauperis. The Clerk of Court shall send Hedrich one Marshal form for each defendant. If Hedrich wishes to use the the Marshals to effect service, he must complete a form for each defendant and return the forms to this Court within 30 days of the date of this order. If Hedrich does not wish to use the Marshals to effect service, he must notify the Court in writing within 30 days of the date of this order and request that a summons be issue directly to him. If within 30 days of the date of this order, Hedrich has not returned the Marshal forms or requested a summons, the Court may dismiss this action for failure to prosecute. Upon receipt of each completed marshal form, the Clerk of Court shall issue a summons and cause the Marshals to serve copies of the summons, complaint, and this order upon the named defendants without Hedrich's payment therefor, unpaid fees to be recoverable if this action terminates by monetary award in the plaintiff's favor. regardless of the method of service Hedrich chooses, he must effect service within 90 days of the date the summons is issued. it is Hedrich's responsibility to inquire of the Marshals as to whether service has been made and if necessary, to request an extension of time for service. if within 90 days of issuance of the summons, Hedrich has not made service or requested an extension of time in which to do so, the Court may dismiss this action for failure to prosecute. Hedrich shall notify the Court in writing if his address changes. The Court may dismiss the action if Hedrich fails to do so.. Signed by Hon. Lawrence J. Vilardo on 1/10/2020.
