Filing 12 TEXT ORDERThe plaintiff has moved to stay this matter pending resolution of his pending motion under CPL 440.10 in New York Supreme Court, Cattaraugus County. See Docket Item #11 . He also has moved to amend his complaint to (1) dismiss defendant Lori P. Rieman as a defendant to this action; (2) strike his demand for vacatur of his conviction and criminal prosecution of the named defendants; and (3) add Cattaraugus County as a defendant to this action. See id. The Court grants both motions in their entirety. When "developments in a related criminal action may ultimately effect [sic] the viability of [a] claim [barred by the favorable-termination requirement of Heck v. Humphrey, 512 U.S. 477 (1994),]... a stay of the [section] 1983 action may be appropriate while the criminal action pends." Smith v. Campbell, 782 F.3d 93, 101 (2d Cir. 2015) (citations omitted). That is the case here, as Maull represents that he currently is challenging the validity of the convictions underlying his otherwise-barred section 1983 claims. See Docket Item #11 . IT IS HEREBY ORDERED that Maull's motion to amend the complaint is GRANTED and the Clerk of Court shall update the caption accordingly; and it is further ORDERED that Maull's motion to stay this matter is GRANTED; and it is further ORDERED that Maull shall file a status report with the Court every 90 days updating the Court on the status of his pending CPL 440.10 motion. Failure to do to so may result in dismissal of the complaint for failure to prosecute under Rule 41(b) of the Local Rules of Civil Procedure for the United States District Court for the Western District of New York.
