June 20, 2023 Opinion or Order Filing 59 DECISION AND ORDER: APA's and Canzoneri's motion to dismiss, Docket Item 55, is GRANTED in part and DENIED in part. Vito's FCA and NYFCA retaliation claims against APA may proceed, but his remaining claims are dismissed. The Clerk of the Court shall terminate Canzoneri as a defendant to this case. SO ORDERED. No later than 30 days after any second amended complaint is filed, the defendants may answer, move against, or otherwise respond to the second amended complaint. If Vito does not amend his complaint within 30 days of the date of this order, then his amended complaint will be dismissed without further order and the Clerk of the Court shall close the case.
