October 6, 2020 Opinion or Order Filing 5 TEXT ORDER denying #2 Motion for Leave to Proceed in forma pauperis as incomplete. Plaintiff indicates that he is employed as a seasonal worker at a gold club, however, it is unclear whether he is making $244 or $330 per week as he lists both figures as his weekly wages. He also receives two pension benefits, however, their exact amount is unclear because plaintiff's motion states that he receives $844.99 and $800 per month in combined benefits. Plaintiff also indicates that he receives $1755 per month in social security benefits, while his wife, who resides with him, receives $1075 per month. Despite that, plaintiff indicates that he receives $2006 per month in social security benefits. Additionally, in paragraph 10 of his motion, he states that his wife contributes her social security benefit of $1283.30 towards their household expenses. Similarly, Plaintiff's exact monthly expenses are unclear. Based on the Court's review of plaintiff's monthly income, expenses, and funds available in his checking account, the Court cannot determine whether plaintiff has set forth sufficient indications of indigency, thus, plaintiff's in forma pauperis motion is DENIED. Plaintiff has until November 6, 2020 to (1) re-file his application using the Court's standard form with all of the relevant information included, or (2) pay the $400.00 filing fee. If plaintiff has not complied with either of these options by November 6, 2020, the Clerk of Court is directed to dismiss this case without prejudice and without further order. Signed by Hon.
