Filing 5 NOTICE of Appearance by Eric Dale Poole on behalf of Commissioner of Social Security (Poole, Eric) |
Filing fee received: $402.00, receipt number BUF070893 (CGJ) |
Filing 4 TEXT ORDER denying #2 Motion for Leave to Proceed in forma pauperis as incomplete. Plaintiff is not employed, resides alone, and receives assistance from the government in the amount of $572 and from the family in the amount of $300. Upon review of plaintiff's application, is unclear, however, as to what income she uses to cover rent considering the assistance she receives from the government and family members are not sufficient to cover the entire rent payment. Based on the lack of sufficient information, the Court cannot determine whether plaintiff has set forth sufficient indications of indigency, thus, plaintiff's in forma pauperis motion is DENIED. Plaintiff has until February 24, 2021 to (1) re-file her application using the Court's standard form with all of the relevant information included, or (2) pay the $402.00 filing fee. If plaintiff has not complied with either of these options by February 24, 2021, the Clerk of Court is directed to dismiss this case without prejudice and without further order. Signed by Hon. Frank P. Geraci, Jr. on 1/25/21. (NNR)-CLERK TO FOLLOW UP- |
