February 22, 2021 Filing 5 TEXT ORDER denying #2 Motion for Leave to Proceed in forma pauperis as incomplete. Plaintiff indicates that he is not employed, and receives public assistance in the amount of $750, and food stamps in the amount of $400. Plaintiff resides with his spouse, who receives $815 per month in social security disability, and four minor children. Plaintiff indicates that his monthly expenses in the total amount of $2,700 are paid by the public assistance received by his family, however, because plaintiff's expenses exceed the amount of income or assistance he receives, the Court cannot determine whether plaintiff has set forth sufficient indications of indigency. Therefore, plaintiff's in forma pauperis motion is DENIED. Plaintiff has until March 22, 2021 to (1) re-file his application using the Court's standard form with all of the relevant information included, or (2) pay the $402.00 filing fee. If plaintiff has not complied with either of these options by March 22, 2021, the Clerk of Court is directed to dismiss this case without prejudice and without further order. Signed by Hon. Frank P.
