Filing 23 TEXT ORDER. The parties have made a timely joint motion to opt out of Alternative Dispute Resolution (ADR). #22 . Under Section 2.2(C) of this District's ADR Plan, an "opt out" motion shall be granted only for "good cause" shown. A party seeking relief from ADR must set forth the reasons why ADR has no reasonable chance of being productive. Inconvenience, travel costs, attorney fees, or other causes shall not constitute "good cause" under the Plan. The parties submit that they believe ADR would not have a reasonable chance of being productive in this case because they have already engaged in settlement negotiations between counsel and with a private mediator. The Court finds that this does not constitute good cause to be excused from ADR. See Christophers Pizza, Inc. v. Direct Capital Corp., 03-CV-722, 2006 U.S. Dist. LEXIS 23429, at *6 (W.D.N.Y. Apr. 26, 2006) (finding that although the parties had already engaged in settlement discussions independently and with a judicial mediator, participation in the ADR program would allow a second chance at mediation in front of a different neutral party and allow the parties to reconsider their positions and re-evaluate the case).Accordingly, the parties' joint motion to opt out of ADR is #22 DENIED. The parties shall select a mediator and file a stipulation confirming their selection by 6/9/2023. All deadlines set forth in the Case Management Order #21 shall remain in effect. SO ORDERED.
