ORDER denying without prejudice as premature #3 Motion to Appoint Counsel; granting #2 Motion for Leave to Proceed in forma pauperis; that the Clerk of Court shall file plaintiff's papers and cause the United States Marshal to serve copies of the summons, complaint, motion to proceed in forma pauperis, and this order upon the named defendants without plaintiff's payment therefor, unpaid fees to be recoverable if this action terminates by monetary award in the plaintiff's favor; that plaintiff must effect service within 90 days of the date the summons is issued; that it is plaintiff's responsibility to inquire of the Marshal as to whether service has been made, and if necessary, to request an extension of time for service; that if plaintiff has not make service or requested an extension of time in which to do so, the Court may dismiss this action for failure to prosecute; that plaintiff shall notify the Court in writing if his address changes; that the Court may dismiss the action if he fails to do so.
