Filing 5 Letter re 4 Text Order filed by Karrie Weber. Filing fee received $ 405 receipt number ANYWDC-5067538, filed by Karrie Weber.(Bernhardi, William) Modified on 1/2/2024 (CGJ). |
Filing 4 TEXT ORDER denying #2 Motion for Leave to Proceed in forma pauperis as incomplete. Plaintiff is not employed, receives child support and government benefits that cover her food expenses, as well as support from her mother, who covers "all utilities, mortgage, etc." Plaintiff, however, does not specify the amount of such expenses, nor indicate the exact contribution that she receives from her mother as paragraph # 10 instructs her to do. Also, plaintiff's child appears to live with her, but it is unclear whether she has included all of the child's expenses on her application. Based on the lack of sufficient information, the Court cannot determine whether plaintiff has set forth sufficient indications of indigency, thus, plaintiff's in forma pauperis motion is DENIED. Plaintiff has until December 28, 2023, to (1) re-file her application using the Court's standard form with all of the relevant information included, or (2) pay the $402.00 filing fee. If plaintiff has not complied with either of these options by December 28, 2023, the Clerk of Court is directed to dismiss this case without prejudice and without further order. Signed by Hon. Elizabeth A. Wolford on 11/28/23. (NNR)Clerk to Follow up |
