ORDER TRANSFERRING CASE: For the reasons set forth in the attached Order, the Clerk of Court is directed to transfer this action to the United States District Court for the Western District of New York, pursuant to 28 U.S.C. 1406(a). The Court offers no opinion on the merits of the petition. Petitioner's request to proceed in forma pauperis is reserved for the transferee Court. That provision of Rule 83.1 of the Local Rules of the Eastern District of New York which requires a seven-day delay is waived. The Clerk of Court is directed to close this case and to mail a copy of this Order to pro se Petitioner.The Court certifies, pursuant to 28 U.S.C. 1915(a)(3), that any appeal from this Order would not be taken in good faith; therefore, in forma pauperis status is denied for the purpose of an appeal.
