Filing 44 DECISION AND ORDER granting in part and denying in part 25 Motion for Summary Judgment. Davey Tree is directed to pay for CSXs defense of the lawsuit by Plaintiff against CSX. To that extent, CSXs motion (Docket No. 25) is granted and the Clerk is directed to enter judgment for CSX with regard only to Count II of its third party complaint (Docket No. 10).
