DECISION AND ORDER granting in part 8 Motion to Dismiss as follows: Plaintiffs federal and state-law free-speech retaliation claims are dismissed with prejudice pursuant to FRCP 12(b)(6), and pursuant to 28 U.S.C. § 1367(c)(3) the Court declin es to exercise jurisdiction over the remaining claims, which, accordingly, are dismissed without prejudice. See, Ginsberg v. Healey Car & Truck Leasing, Inc., 189 F.3d 268, 273 (2d Cir. 1999) (Affirming the dismissal of state law claims without prejudice pursuant to 28 U.S.C. § 1367(c)(3)).
