Filing 58 DECISION & ORDER Defendant's motion for a protective order 47 is denied. Defendant's motion to compel plaintiff to continue her deposition 53 is granted, although the request for an order imposing costs is denied. Both parties are dir ected to contact chambers within 10 days to schedule the deposition, which shall occur in this Courthouse and be completed within two hours and thirty minutes. Both parties are reminded of their legal and ethical obligations to cooperate with one an other, treat each other with courtesy and respect and conduct discovery, and all other aspects of this litigation, in good faith. Failure to do so may result in the imposition of sanctions and/or the requirement that either or both parties bear the costs of a discovery referee to be appointed by the Court. It is also Ordered that the Court's 6/10/2014 Amended Scheduling Order 45 shall be amended as follows: Fact Discovery to be completed by 6/30/2015. Dispositive Motions due by 9/1/2015. The first amended complaint 8 is dismissed, without prejudice to plaintiff's filing of a second amended complaint, asserting only a claim under Title VI, against the Penfield Central School District only.
