Filing 47 -CLERK TO FOLLOW UP-ORDER that plaintiff's amended complaint fails to state a federal cause of action upon which relief can be granted, and that there is no basis for this Court to exercise jurisdiction over his remaining state law claims. Defe ndants' motion to dismiss 42 is granted in part, plaintiff's First Amendment claim is dismissed with prejudice, and the matter is remanded to the New York State Supreme Court, Monroe County for adjudication of plaintiff's state common law claims.
