Filing 19 DECISION AND ORDER. Defendants' Motion to Dismiss 15 is GRANTED IN PART and DENIED IN PART. The Motion is granted with respect to the claims against ADA Dennis and Ontario County, and those parties are hereby dismissed from this action. The Motion is denied with respect to Deputy Cordon, although the qualified immunity issue may be re-raised as part of a properly supported motion for summary judgment. By separate order, this matter will be referred to a United States Magistrate Judge for all pretrial matters, excluding dispositive motions. IT IS SO ORDERED. Signed by Hon. Frank P.
