Filing 46 DECISION AND ORDER granting in part and denying in part 25 Motion for Summary Judgment. The Court grants Corning's motion for summary judgment, ECF No. 25, in part and directs entry of judgment for Corning on all the federal claims alleged in the amended complaint, which includes the First, Second, Eighth (as derivative of the federal claims), Ninth, Tenth, Eleventh, and Twelfth causes of action. Because the Court has dismissed all the federal causes of action, it declines to exercise jurisdiction over the state claims pursuant to 28 U.S.C. § 1367(c)(3). The Clerk of the Court is directed to close this case.Signed by Hon. Charles J. Siragusa on 5/16/19. (KAP)-CLERK TO FOLLOW UP- |
