Filing 18 DECISION & ORDER: For the reasons stated, Plaintiff's Motion for Summary Judgment as to Defendant Campbell is GRANTED; Plaintiff's Motion to Amend the Caption is GRANTED IN PART and DENIED IN PART; Plaintiff's Motion for Attorney 39;s Fees and Costs is DENIED without prejudice; and Plaintiff's Motion for a Judgment of Foreclosure and Sale is DENIED without prejudice. Plaintiff is ordered, within 30 days of the date of this Order, to move for appropriate relief as to Defendants Mansfield, John Doe, and Mary Roe, or in the alternative, to show cause why these Defendants should not be dismissed from this case.Furthermore, to the extent that Plaintiff seeks either summary judgment or default judgment agai nst Defendants John Doe and Mary Roe, Plaintiff is ordered, within 30 days of the date of this Order, (1) to determine the real names of Defendants Doe and Roe or, alternatively, (2) to provide the Court with legal authority establishing that it may continue to use fictitious names for Defendants Doe and Roe more than three years after this suit was brought and that default judgment may be entered against defendants identified with fictitious names.
