Filing 28 ORDER denying 27 Motion to Appoint Counsel. Plaintiff will be afforded one final opportunity to file a proper amended complaint. Plaintiff must file such amended complaint by 12/9/16. Failure to do so will result in the dismissal of Plaintiff' s claims against Defendants Billiet, Van Geldon, and Crowe. Plaintiff's time to respond to Defendant LiPodagrossi-Torbitt's 25 motion to dismiss is also extended to 12/9/16. Failure to respond may lead to dismissal of Plaintiff's cla ims against Defendant LiPodagrossi-Torbitt. Defendant LiPodagrossi-Torbitt's reply will be due fourteen days after Plaintiff's response, if any, is filed. SO ORDERED. Signed by Hon. Elizabeth A. Wolford on 11/16/16.
